PERSONAL DATA PROTECTION POLICY

Pursuant to the General Data Protection Regulation (“GDPR”)

WHO WE ARE

NICE S.p.A. (hereinafter “NICE” or the “the Company”, with its registered office at 31046 Oderzo (TV), Via Callalta no. 1, is the data controller for the personal data collected through the MY NICE App (hereinafter also simply “the App”) and devotes the utmost attention to the security and confidentiality of the personal data which it acquires.

WHICH PERSONAL DATA MAY BE COLLECTED AND FOR WHAT PURPOSES, NATURE OF DATA PROVISION

The information that NICE may collect with the MY NICE App is as follows.
-Username and password: this information is requested to identify the User during the login phase
and is this instrumental to the use of the App. Failure to provide this data will therefore prevent
any use of the App; (legal basis for contract performance or precontractual measures)
-E-mail address: this information will be requested to identify the User during the login phase and is
therefore necessary and instrumental to the use of the App and to fulfil requests for information
regarding NICE products or NICE resellers and/or distributors. Failure to provide such information
will therefore prevent the functioning of the App and the receipt of responses to any requests
submitted to the Data Controller. (legal basis for contract performance or precontractual

With the user's consent, this information (e-mail address) may also be used:
to send commercial communications and information, including of a promotional nature (such as
the NICE Newsletter), advertising material and/or offers of goods and/or services by the Data
Controller, market research and statistical surveys. Providing your data for this purpose is strictly
optional. (legal basis for consent)
-Name, surname, telephone number and address of residence: this information, where you have,
provided it, may be used to fulfil requests for information regarding NICE products or NICE resellers
and/or distributors. Failure to provide it will prevent the Data Controller from responding to your
requests for information regarding products and/or distributors. (legal basis for precontractual
measures)
With the user’s consent, this information (Name, surname, telephone number and address of
residence) may also be used:
to send commercial communications and information, including of a promotional nature (such as
the NICE Newsletter), advertising material and/or offers of goods and/or services by the Data
Controller, market research and statistical surveys. Providing your data for this purpose is strictly
optional. (legal basis: consent)
-Date of birth: this information is strictly optional and with the User’s consent it will be used:
to send commercial communications in line with your preferences, on the basis of a specific User
profile. (legal basis: consent)

The image that the User may upload as further information for his or her profile will only be visible to the User, from the User's own device, and not to NICE.

HOW WE KEEP YOUR PERSONAL DATA SAFE

The Company adopts adequate security measures with a view to constantly improving the protection, safety, integrity and accessibility of your personal data.

All your personal data is stored on protected servers or those of our suppliers, and it is accessible and usable according to our standards and safety policy (or an equivalent standard for our suppliers).

PROCESSING METHODS

Data is processed using electronic and telematic instruments, according to organisational methods and logic that are strictly related to the specified purposes.

HOW LONG WE KEEP YOUR DATA FOR

The Company keeps your personal data for a period no longer than required to achieve the purposes for which it has been collected.

In particular, the data required for the use of the App or to respond to your requests will be kept for the duration of your use of the App and then erased 12 months from the deletion of the related account, i.e. for the time necessary to respond to your request.

In the event of marketing activities involving the use of your e-mail address, name, surname, telephone number and address of residence, such data will be kept for the periods specified above; however, we will periodically request your consent, at least every 24 months, for such purposes so as to respect your choices.

For profiled marketing purposes it will be kept for 12 months.

WHO WE CAN SHARE YOUR PERSONAL DATA WITH

Your personal data will be accessible, on NICE’s behalf, solely to employees who perform the duties of system administrator or parties expressly authorised by such persons.

Any users who have a NICE Core or IT4 WIFI device, which you may use to share access to the management of your automation, may have access from their devices, with your authorisation, to the following personal data: the User’s name and surname.

YOUR DATA-PROTECTION RIGHTS AND YOUR RIGHT TO LODGE COMPLAINTS WITH THE SUPERVISORY AUTHORITIES

Under certain circumstances, you have the right to:
-request access to your personal data;
-request a copy of the personal data that you have provided (known as data portability),
-request rectification of the data in our possession;
-request erasure of any data which the Company does not have the right to process;
-object to processing as contemplated by applicable laws;
-restrict the way the Company processes your personal data, within the limits envisaged by
applicable laws;
-revoke your consent for processing based on consent.

Enforcement of these rights is subject to certain exceptions aimed at safeguarding public interest (for instance, to prevent or identify criminal activity) or the interests of Society as a whole. In case you decide to enforce even one of the aforementioned rights, the Company will be responsible for checking whether you are entitled to enforce said rights and you will be notified of the outcome, generally speaking, within one month.

If you wish, you may lodge a complaint with the Italian data protection authority, using the information available on the website https://www.garanteprivacy.it/, or you may take appropriate legal action.
